Welcome to The Fence Dudes (“Company,” “we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our website, estimates, communications (including SMS), scheduling, and fence installation/repair services (collectively, “Services”). By using our Services, you agree to these Terms.
1. Services
The Fence Dudes provides residential and commercial fencing services, which may include consultations, measurements, estimates, installation, repairs, staining/sealing, and related work.
2. Estimates, Pricing, and Quote Validity
Estimates/quotes are valid for 30 days from the date issued, unless otherwise stated in writing.
Pricing may change due to material availability, supplier price changes, jobsite conditions, scope changes, permitting requirements, or requests made after the quote is issued.
Any change to scope (including hidden conditions such as underground obstructions, unmarked lines, rock, or rotten posts/structure) may require a revised estimate or change order.
3. Scheduling, Access, and Delays
Work is scheduled based on crew availability, material lead times, and weather. Estimated start dates are not guarantees.
You agree to provide reasonable access to the jobsite, including gates/unlocked access and clearance of obstacles and personal property near the work area.
We are not responsible for delays caused by weather, supplier delays, permitting timelines, utility marking schedules, HOA restrictions, customer rescheduling, or other events outside our control.
4. Cancellations and Rescheduling
If you need to reschedule, please provide as much notice as possible. Deposits or special-order materials may be non-refundable where applicable (or may incur restocking/cancellation fees from suppliers). If you cancel after materials have been purchased or crews have been scheduled, you may be responsible for related costs.
5. Payments
Payment terms (including deposits and final payment) will be stated on your estimate, invoice, or proposal. Past-due balances may result in paused work, withheld scheduling, and/or late fees where permitted by law.
6. Permits, HOA, and Property Lines
Unless explicitly stated in writing, the customer is responsible for confirming property lines, easements, surveys, and HOA requirements/approvals.
Permits are handled by the customer unless our proposal specifically states that we will obtain them.
We install fencing where directed by the customer; disputes over boundaries or encroachments are the customer’s responsibility.
7. Utility Marking (“Call Before You Dig”)
Customers are responsible for ensuring utilities are marked when required. We may request utility marking before work begins. We are not liable for damage to unmarked, privately installed, or incorrectly marked lines (including invisible dog fences, sprinkler systems, landscape lighting, septic lines, and similar).
8. Site Conditions and Property Protection
We take reasonable care to protect landscaping and the jobsite, but fence work can involve digging, post removal, concrete, and heavy materials. Minor lawn disturbance and normal construction impacts may occur. Restoration beyond normal cleanup (e.g., sod replacement, specialty landscaping repair) is not included unless specifically stated in writing.
9. Warranty and Materials
Any workmanship warranty (if offered) and material/manufacturer warranties will be described in your proposal or invoice. Natural materials like wood may warp, crack, shrink, swell, or change color due to weather and age. Routine maintenance may be required.
10. Photos and Marketing
We may take photos/videos of the worksite before, during, and after installation for documentation and quality control. Unless you request otherwise in writing, you grant permission for us to use non-sensitive project images for marketing purposes (no personal identifying info).
11. Communications Consent (Calls, Email, SMS)
By providing your phone number and/or email, you consent to receive communications related to estimates, scheduling, project updates, invoices, and customer service via call, email, or text message.
12. SMS Program Terms
If you opt in to SMS messages:
You may receive appointment confirmations, reminders, project updates, and customer service messages.
Message and data rates may apply.
Message frequency may vary.

No mobile information will be shared with non-affiliate third parties for marketing/promotional purposes. Information may be shared with subcontractors or service providers strictly to support operations such as customer service, scheduling, or messaging delivery.
13. Limitation of Liability
To the maximum extent permitted by law, The Fence Dudes is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim related to Services will not exceed the amount you paid us for the specific work giving rise to the claim.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of our Services after changes are posted means you accept the updated Terms.
